Furthermore, these GTC apply to any commercial transaction in Hungary concluded between the Parties defined in this contract. - 2.3. Registration is not required to make a purchase in the "TBERCI" Online Store, but the applicable order form must be completed as set out in the GTC and the Privacy Notice.
- 2.4. After placing an order, the contract may be freely modified or cancelled without consequence until its performance. This can be done by e-mail. The contract concluded between the Parties by means of the order, in Hungarian, is deemed to be a contract concluded in writing, in accordance with the terms of the GTC and the Privacy Notice.
- 2.5. The language of the contract is Hungarian.
- 2.6. The Service Provider is not subject to the provisions of any code of conduct.
3. Ordering and the purchasing process
- 3.1. By placing an order on the Website, the Customer declares that they have read and accept the terms of these GTC and the Privacy Notice published on the Website, and consent to the data processing described in the Privacy Notice.
- 3.2. The Service Provider bears no responsibility whatsoever for delivery delays or other problems or errors resulting from incorrect and/or inaccurate data provided by the Customer.
- 3.3. Any product available in the Online Store may be ordered. The Customer can obtain information about the properties, characteristics of the products and the conditions of ordering on the specific product page. If more information is needed regarding the quality, essential characteristics, use or usability of any product on the Website, please contact the Service Provider using the contact details provided.
- 3.4. The purchase price is always the amount indicated next to the selected product, which, unless otherwise indicated, already includes value added tax. Whether the purchase price of the products includes the cost of delivery can be found directly in the product description.
- 3.5. The Service Provider reserves the right to change the prices of products that can be ordered from the Website, provided that any change takes effect upon publication on the Website. Such changes do not adversely affect the purchase price of products already ordered.
- 3.6. If, despite the Service Provider's due care, an incorrect price appears on the Website (e.g., a price significantly different from the well-known price, or a price of "HUF 0" or "HUF 1" appearing due to a system error), the Service Provider is not obliged to deliver the product at the incorrect price, but may offer delivery at the correct price, upon becoming aware of which the Customer may withdraw from their intention to purchase.
- 3.7. The Service Provider only accepts an order placed via its Website if the Customer has completed all fields required for the order in full. The Service Provider bears no liability for errors resulting from incorrect and/or inaccurate order data.
- 3.8. Orders can primarily be placed in the "TBERCI" Online Store, following product selection. After written coordination, an order placed by e-mail is only possible following confirmation. Orders by phone or fax are not possible.
- 3.9. The Customer may order the selected products by completing the form on the WooCommerce platform. A separate delivery and billing address may be provided. Clicking the "Pay" button initiates payment by bank card, finalizing the order.
- 3.10. Following successful payment by bank card, the system begins processing the order to the extent stock is available.
- 3.11. Following successful payment, the Service Provider sends an automatic confirmation by e-mail and issues an electronic invoice through the billingo.hu system.
- 3.12. In the case of a physical product, the order data is forwarded to the logistics partner for packaging. For orders placed on a business day before 12:00 noon, delivery takes place within 24 hours (or on the next business day).
- 3.13. In the case of a digital product (e.g., e-book, video), the order data is forwarded to the e-mail system within 10 minutes at the latest, which automatically sends the product or the download link.
- 3.14. If the Customer notices an error after submitting the order, they must report it to the Service Provider without delay (within 30 minutes on a business day in the case of a physical product).
- 3.15. The order constitutes a contract concluded by electronic means in accordance with the Hungarian Civil Code (Act V of 2013), the E-Commerce Act (Act CVIII of 2001), Government Decree 45/2014 (II.26.), and Directive 2011/83/EU of the European Parliament and of the Council.
- 3.16. Once the parcel is handed over to the courier service, the courier sends a notification with the expected delivery time and the tracking number.

6. Right of withdrawal
- The right of withdrawal applies exclusively to natural person purchasers acting outside the scope of their trade, occupation, or business activity ("Consumer").
- The Consumer is entitled to withdraw from the contract without giving a reason within 14 (fourteen) days of receiving the product. The right of withdrawal may also be exercised in the period between the conclusion of the contract and receipt of the product.
- Exceptions to the right of withdrawal: The Consumer is not entitled to the right of withdrawal in the case of sound or video recordings, or software, supplied in a sealed package that has been unsealed after delivery; in the case of custom-made or personalized products produced at the Consumer's express request; and in the case of digital content not supplied on a tangible medium, if performance has begun with the Consumer's prior express consent.
6.1. Procedure for exercising the right of withdrawal
| Step | Details |
|---|
| Declaration | The Consumer must communicate their unambiguous intention to withdraw in writing (by post or by e-mail to info@tberci.com) within the 14-day deadline. |

7. Warranty (guarantee)
- 7.1. Mandatory guarantee: Under the Civil Code and Government Decree 151/2003 (IX.22.), the Service Provider is subject to a guarantee obligation for durable consumer goods. The guarantee period begins upon delivery of the product.

- 7.3. A claim for statutory warranty and guarantee, or for product warranty and guarantee, cannot be enforced simultaneously and in parallel for the same defect.
8. Warranty for defects
8.1. Statutory warranty (kellékszavatosság)
- In the event of defective performance, the Consumer may assert a statutory warranty claim within a limitation period of 2 years from receipt of the product (1 year for non-consumers):
- The Consumer may request repair or replacement, unless this is impossible or would involve disproportionate additional cost for the Service Provider.
- The Consumer may request a proportionate reduction of the consideration, may repair the defect themselves at the Service Provider's expense, or may withdraw from the contract (withdrawal is not available for an insignificant defect).
- The defect must be reported without delay after its discovery, and no later than within 2 months.
- Within 6 months of performance, no proof other than reporting the defect is required, unless the Service Provider proves that the defect arose after delivery. After 6 months, the Customer must prove the origin of the defect.
8.2. Product warranty (termékszavatosság)
- In the event of a defect in movable property, the Consumer may request the manufacturer or distributor to repair or replace the product within 2 years of it being placed on the market.
